Subscription Plans and Credits

Credit System

• Lifetime Plan: A one-time payment plan that provides a recurring monthly allocation of credits.
• Credit Packages: Additional one-time credit purchases available as needed.

Credit Expiration

• Credits may expire after a stated period depending on the plan you choose.
• Unused expired credits are forfeited and non-refundable.
• Subscription and Lifetime plan credits typically reset at the beginning of each billing cycle and do not accumulate or roll over.

Subscription Auto-Renewal

• Monthly and yearly subscriptions automatically renew unless cancelled
• You may cancel auto-renewal at any time through your account settings
• Cancellation takes effect at the end of the current billing period

Payment and Billing

Payment Processing

• Payments are processed securely through our payment providers, including Stripe and PayPal
• You authorize us to charge your chosen payment method
• You agree to provide accurate, complete payment information

Pricing and Fees

Prohibited Activities

• Use the Services for spam, fraud, or deceptive practices

Intellectual Property

• Generated Content: Videos and outputs created by our AI (with active subscription)

You grant us a limited, non-exclusive license to:

• Store generated content for your account
• Display generated content within your dashboard

Our Intellectual Property

MotionControlAI retains all rights to:

• Our AI models, algorithms, and technology
• The platform software, interface, and design
• Our trademarks, logos, and brand identity
• Pre-trained models and foundational technologies

You may not:

• Copy, modify, or distribute our AI models
• Use our trademarks without permission
• Create competing services using our technology

Commercial Use of Generated Content

With an active paid subscription, you may:

• Use generated videos for commercial purposes
• Monetize content on social media, websites, or other platforms
• Include generated videos in client projects

Free tier users are granted a personal, non-commercial license only.

AI Content Limitations

Service Availability

• We do not guarantee uninterrupted or error-free service
• AI outputs may vary in quality and accuracy
• We reserve the right to modify or discontinue features

Output Quality

• AI-generated content may contain errors or unexpected results
• We do not guarantee specific outcomes from prompts
• You are responsible for reviewing generated content before use

Content Moderation

• We reserve the right to review and remove content that violates these Terms
• Automated and manual moderation may be employed
• We are not liable for content removal due to violations

Refund Policy

Refund Eligibility

You may be eligible for a refund in the following circumstances:

Qualifying Refund Situations

1. Technical Failure: If a technical issue prevents you from accessing or using the Services, and the issue persists for more than 24 hours after being reported to support
2. Duplicate Charges: If you are accidentally charged multiple times for the same service
3. Unauthorized Transactions: If you can demonstrate that a charge was made without your authorization
4. Service Not Delivered: If credits are not added to your account within 24 hours of successful payment

Non-Refundable Situations

Refunds will NOT be issued in the following cases:

1. Change of Mind: If you simply decide you no longer want the service
2. Partial Usage: If you have used any portion of the credits or services
3. Expired Credits: Credits that have expired due to the passage of time
4. Account Violations: If your account is terminated due to violation of these Terms
5. Subscription Usage: If you have generated videos during the current billing period
6. Promotional Credits: Bonus or promotional credits awarded for free

Refund Request Process

To request a refund:

2. Provide Details: Include your account email, transaction ID, and reason for refund
3. Verification: Our team will verify your eligibility
4. Processing: Approved refunds are processed within 5-10 business days

Payment Processor Fees

Important: All refunds are limited to the service fees actually paid by you. Transaction fees charged by our payment processors (e.g., Stripe, PayPal) are non-refundable and will be deducted from any refund amount.

• Payment processor transaction fees are not refundable
• You are responsible for these non-recoverable fees
• MotionControlAI is not liable for payment processor fees that cannot be recovered

Refund Method

• Refunds are issued to the original payment method
• Refund amount = Payment amount – Non-refundable processor fees
• Processing time depends on your payment provider (typically 5-10 business days)

Account Termination

Termination by You

• You may delete your account at any time through account settings
• Upon deletion, unused credits are forfeited
• You are responsible for any charges incurred prior to deletion

Termination by Us

We may suspend or terminate your account for:

• Violation of these Terms
• Fraudulent or abusive activity
• Extended inactivity (12+ months)
• Legal requirements or safety concerns

Effect of Termination

• Upon termination, your right to use the Services ends immediately
• We may delete your account data and generated content
• You remain liable for all charges incurred before termination
• No refund will be provided for terminated accounts due to violations

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

AI Output Disclaimer

We do not guarantee:

• The accuracy, quality, or suitability of AI-generated content
• That outputs will meet your expectations or requirements
• That the Services will be error-free or uninterrupted

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOTIONCONTROLAI SHALL NOT BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL
• DAMAGES EXCEEDING THE AMOUNT YOU PAID IN THE PAST 12 MONTHS

This limitation applies to actions based on contract, tort, or any other legal theory.

Indemnification
